CONSANGUINITY

I got my first question after the first post,without blowing my trumpet some people actually missed me ,i miss you all too especially the way you make me feel after viewing the page-views after every post.....lol. The question goes thus....

Can siblings get married to siblings under our law or is it just a Yoruba thing, so i cant fall in love with my sister in law's brother or my bother's wife's brother'


The first thing that came to mind is Love should know no bounds, but then marriage requires more than love 'my opinion' topic for another day, so over to law of the land .

The law that governs Marriage is the Matrimonial Causes ActCap M7 Laws of the Federal Republic of Nigeria and the Matrimonial Causes Rules 1983 and these law only applies to monogamous marriages contracted under the Act or declared to be valid under the Act.

A marriage is void  where the parties are within prohibited degress of consanguinity and affinity under Section 4 of the Matrimonial Causes Act,Marriage of a man is prohibited if the woman has his ancestress, descendants , sister, father's sister, mother's sister , brother's sister, sister's daughter because they both descended from the same ancestor as another person, so also a woman is prohibited if the man is or has been her ancestress, husband's father, husband's sonsister's son and so on.

It is immaterial whether the relationship whether the relationship is of whole blood or half blood, or whether it is traced theough,or to any person illegitimate birth.

Conclusively, a marriage to anyone who descended from the same ancestor as one is void and where the marriage has been conducted this is a good ground for dissolution of such marriage.
