The entertainment industry in
Nigeria is getting bigger and the investors in the industry are not ready to
give chances where artists flaunts their terms of contracts, first it was
between Chocolate city and Brymo now it is between YSG and VECTOR, you never can tell who the
next would be.
The record label through the
federal high court sitting in Ikoyi Lagos has restrained Vector from recording,
releasing, distributing any composition, song, musical or performing for the
benefit of any person or organization other than YSG entertainment Limited or
faces the wrath of law.
In general sense, every order of
court which commands or forbids is an injunction, but in its accepted legal
sense, an injunction is a judicial process or mandate operating inparsonam by
which, upon certain established principles of equity, a party is required to do
or refrain from doing a particular thing.
The mode of seeking a temporary
remedy is by court injunction pending the determination of the judgment; this
is usually sorted where the victim feels failure to restrain the offender might
cause him irreparable damage by continuing the conduct which led to the
dispute. In exercising this right the court will need to be persuaded and
proved to that if the injunction is not granted it will lead to loss on the
part of the victim which the judgment will not be able to solve eventually.
Whether to grant this application is at the discretion of the
court, instances where court will grant injunction include but not limited to
,on-going breach of contract, violation of copyright and trademark law,
wrongful use of information and trade secrets, publication of obvious
defamatory lies
The breach of court injunction will
amount to contempt of court which is an offence known to law punishable with
fine or imprisonment or both.
The power of a lawyer in
reviewing contracts can never be underestimated because it is only a lawyer
