DIVORCE & CHILDREN


Marriage is a contract between two adults and when it comes to an end the adults should face the consequence alone, no child should be made to suffer for the actions of the adults.

Divorce can stressful for children because they are the number one victims in this instance, it can be stressful, sad and confusing for them no matter, the fear of seeing their parents go their separate ways is enough to affect them emotionally.

Children whose parent is in an abusive relationship also find it tasking to handle, but the law has not and will never fold its arms to the wellbeing of children who are victims of separation.

What are the rights of children in divorce?

The one right of children in divorce is the right to develop and maintain an independent relationship with the parents, rights to be free of conflict between the parents.................the following are rights of children in divorce.

i.                     The right to be financially supported by both parents, irrespective of the time spent with the child.

ii.                   Right to be nurtured, disciplined, guided without interference from the other parent.

iii.                  Right to personal sleeping area and space for possession in each parent’s home

iv.                 The right to develop meaningful relationship with other adults, these adults are grandparents, step parents as long as such relationship does not affect the primary relationship of the child and his/her parents.

v.                   The child has the right to be free of conflicts between the parents

vi.                 The right to be physically safe when in the care of either parents

vii.                A right to be protected from those under the influence of alcohol

viii.              Each child has the right to be free from having to take sides with, defend or downgrade either parents

ix.                 Right to spend time, holidays with both parents

x.                   A right to proper education and welfare, these is usually spelt out by the court with the agreement of the parties while the divorce is ongoing.
