MERCY AIGBE: CONTROVERSIAL WEDDING DRESS

A disappointed bride with Instagram Handle RETTYPETTY calls out a Nigerian Designer named RIKAOTOBYME, Maryam Elisha who ruined her wedding day by allegedly giving her wedding dress (bride brought the fabric and paid the designer in full) to a Nollywood actress by the name MERCY AIGBE who used same for her 40th Birthday photo-shoot.

This controversial dress must have caused the Nollywood actress a lot as people flooded her page calling her names almost ruining her 40th birthday celebration for her......................CULLED FROM FAMOUS BLOG

In view of the above scenario, we shall be looking at the rights of the parties involved under the law. The parties are the designer, the bride and the Nollywood actress.This is a case of breach of contract.


What is a Contract? A contract is a voluntary agreement between two or more parties enforceable by law as binding.The element of a valid contracts are, offer and acceptance,mutual consent of parties, intention to create an obligation , party must be competent and the object of contract must be lawful.

Is there a contract between the Designer and the Bride? The moment she accepted the fabric, her measurement, part or full payment a contract begins, and it is binding on her to deliver as agreed.This covers the major element of the contract, an offer was made by the bride and accepted by the designer, mutual agreement to make a certain style and deliver at an agreed date .

Whether sowing of a cloth is a lawful object ? Yes it is lawful. example of unlawful things are: contract to kidnap, contract to sell a child etc. Sale of items, sowing of clothes, shipping of goods etc are lawful objects.

Whether Mercy Aigbe is guilty ? Mercy is not a party to the contract between the designer and the bride but just a victim of cyberbully and cannot be sued for a breach irrespective of how she got the dress, whether as a gift or purchased for value, rather she stand the chance of suing the designer.

What are the options available to the bride? The bride has the right to sue the designer for breach of contract by asking for damages in lump sum.
