ISSUANCE OF DUD-CHEQUE

The managing Director of Bluehill Hotel Resort Limited, Jonathan Wallang was on Thursday dragged before Justice Bello Kawo of the Federal High Court, Abuja sitting
in Kubwa by the Economic and Financial Crimes Commission (EFCC) for alledgely issuing a dud-cheque of N35,000,000 (Thirty Five Million Naira Only)

According to the prosecutor Wallang purchased two cars Mercedez S63 and  BMW X6 from Ropshik Global concept Limited in November,2013, he was said to have initially paid cash deposit of N14,500,000 (Fourteen Million Five Hundred Thousand Naira Only) after which he issued Zenith Bank Cheque amounting to N35 Million on December, 2013 to the complainant which was returned unpaid upon presentation at the bank.

The offence is contrary to Section 1(1a) and Section 1(1b) of the Dishonoured cheques (offences) Act, CAP D11, Laws of the Federation.

LEGAL OPINION

The Central Bank of Nigeria  has opted for prosecution of the offenders under the issuance of dud-cheques Act 1977. The law stipulates a two years jail term upon conviction for offender, all offenders shall be handed over to the Economic and Financial Crimes Commission for prosecution through the Federal High Courts.
