FUNKE AKINDELE : PEROGATIVE OF MERCY

In Criminal law what serves as deterrence is not the severity of punishment but the certainty of punishment -TW


The Star Actress Funke Akindele Bello and her husband JJC Skills were both arraigned before the Chief Magistrate Court 1 Ogba,  Lagos in the early hours of today following an arrest that bothers on  violation of Corona Virus Pandemic Bill 2020 after throwing a party in celebration of her husband, JJC Skills birthday party.

Mr & Mrs Bello who pleaded guilty to the offence where both sentence to a Fourteen (14) days community service, One Hundred Thousand Naira (N100,000:00) fine and isolation for 15 days in a place to be determine by the Lagos State Ministry of Health. This judgement to so many is fair as their fans across the country were worried and aired their opinion that it was taken too far but law is no respecter of anyone irrespective of class.

The question now is what is the effect of such judgement of the convicts,  the status of the accused persons now is that of an ex-convict ……….SAD?

The good news is that by virtue of Section 175 of the  Constitution of the Federal Republic of Nigeria ' The President may grant any person concerned with or convicted of any offence created by an act of the National Assembly a pardon , either free or subject to lawful condition . OBIDIKE V. STATE (2001) 17 NWLR (743) 601 this is simply referred to as PEROGATIVE OF MERCY, this is an important component of executive powers which allows the President to grant pardon, as a way of dispensing mercy of government.


The legal effect of presidential pardon is profound as it exempts , frees and release the convict of all liabilities as if they never committed the offence they were pardoned for, many Nigerians who have benefitted from this includes Ex Bayelsa State Governor , Alamieyeseigha , Chief Olabode George and many more. We hope someday Mr & Mrs Bello will benefit from it considering her role in the Nollywood industry.
