PRESIDENT BUHARI & HIS FIGHT AGAINST CORRUPTION

A High Court of the Federal Capital Territory today dismissed all the 18 counts charges including gratification against Justice Adeniyi Ademola of the Federal High Court and his wife, Olubowale Ademola and a Senior Advocate ,Mr Joe Agi.

Justice Jude Okeke discharged the three defendants in a ruling upholding the respective no-case submissions filed by the defendants. The prosecution was unable to make out a prima facie case with respect to any of the 18 counts charges on concluding its case despite calling Nineteen witnesses and exhibits A to Z .

It was held that the prosecution was unable to to show contrary evidence to the claim by the defendant in the sum  of N30 Million was not a gift passed from two mutual friends of Justice Ademola and Agi in support of the Ademolas daughter's wedding held in year 2015.

LEGAL OPINION- what no-case submission simply means is that 'no case to answer'  this is a case whereby a defendant seeks acquittal without having a present defense, this happens mostly where the Prosecution has failed to established through its evidences and exhibits before the court that the accused person(s) has committed an offence. The court is not a father Christmas and will not establish a case where none is proved before it.SEE FGN V, BANKOLE & NAFADA where the totality of the prosecution did not establish a prima-facie case against them and subsequently discharged the defendants

Conclusively , the case of the prosecution was built on strong suspicion and speculation fueled by by the feeling of fight against corruption which no reasonable court could base any conviction on.

Thank you
