Prince Abubakre Audu, the All Progressive Congress candidate
in the yesterday governorship election, reportedly slumped and died this
afternoon.It was gathered that he died of undisclosed medical reasons after the
Independent National Electoral Commission (INEC) declared his election
inconclusive. (May his soul Rest in Peace)
This left several questions unanswered among Nigerians, so i
feel its time to break the long silence too.
The Constitution of the Federal Republic of Nigeria on death
of governor elect before oath of office.............
The position of law is clear on this by virtue of the
provision of the Nigeria Constitution
1999 , Section 181 state that if a person duly elected as governor dies
before taking and subscribing the Oath of Allegiance of office, or is unable
for any reason whatsoever to be sworn in, the person elected with him as Deputy
Governor shall be sworn in as Governor and shall be nominated as new
Deputy-Governor who shall be appointed by the Governor with the approval of a
simple majority of the House of Assembly of the State. Subsection 2 further state that where a person duly elected as
Governor and deputy Governor of a state dies or are for any reason unable to
assume office before the inauguration of the House of Assembly, the Independent
National Electoral shall immediately conduct an election for a Governor and
Deputy Governor of the State.
The above provision of the law is applicable to Governor-elect,
since INEC declared the election inconclusive then the above provision of the
law is not applicable to the late Prince Abubakre Audu.
An election is said to be inconclusive where the result
available does not lead to a resolution or conclusion.
